Lunch Breaks-Specific Situation
We have a dealership who was visited by the DLSE. They requested to see time records. They were specifically looking for when techs were taking their lunch periods. As a result, they are now directing the client to conduct a 3 year, self-audit, on all time records. Each violation will cost the dealership one hour of pay for each violation per individual.

We are having them sign a statement on their time sheets stating they have taken all meals &l breaks. We pay any overtime they work but, they do not always clock out for lunch or breaks.
The process sounds great but if an individual consistently fails to clock in and out, they must be given progressive discipline to let them know they are in serious violation of the policy. They do not have to clock out for breaks because breaks are paid.
